Lexandria, Inc. (“Lexandria,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it. This Privacy Policy describes how we collect, use, disclose, and protect information in connection with our website(s) and related services, including the educational resources, materials, and content made available thereon (collectively, the “Platform”). Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in our Terms of Use.
By accessing or using the Platform, you agree to this Privacy Policy. If you do not agree with our policies and practices, do not use the Platform.
Scope and Audience
This Privacy Policy applies to information we collect:
On the Platform.
In email, text, and other electronic messages between you and the Platform.
From Schools and other Institutions and their School Personnel in connection with instruction, assessment, and learning management.
From homeschooling parents/guardians who enable at-home educational use of the Platform and the Content.
Children and Students
We design the Platform for use by teachers, School Personnel, students, and parents for bona fide educational purposes.
Children under 13. We do not knowingly collect Personal Information from children under 13 outside school-directed use or verifiable parental consent. For school-directed use of the Platform, Institutions may provide consent as the parent’s agent under COPPA for Lexandria to collect Personal Information strictly for educational purposes. For at-home or homeschooling use outside an Institution, a parent or legal guardian must create the child’s account or provide verifiable consent prior to the child’s use. Institutions are responsible for providing required notices and obtaining and maintaining consents under COPPA.
Students and FERPA. To the extent we receive, access, or maintain “education records” (as defined by FERPA) on behalf of an Institution, Lexandria acts as a “school official” with a “legitimate educational interest” and processes such records solely to provide and support the Platform and Content to the Institution, its School Personnel, and students, consistent with FERPA and other applicable student privacy laws.
If you believe we have collected information from a child under 13 without the appropriate consent, please contact us using the information in the “Contact Us” section below, and we will take appropriate steps to delete such information.
Information We Collect
We collect information necessary to provide, maintain, secure, troubleshoot, and improve the Platform and Content, as described below.
Account and Profile Information. We collect information when you create or manage an account, including name, email address, role (for example, teacher, student, parent, administrator), Institution and class affiliations, student gender, and Log-In Information. Students’ accounts may also include school- or parent-provided identifiers and class rostering data.
Educational and Instructional Information. We collect information that is created or uploaded to the Platform in the course of instruction and assessment, including assignment submissions, quiz and activity responses, scores, feedback, progress metrics, timestamps, class rosters, and any other User Content you provide. For Institutions, this may include educational records subject to FERPA.
Communications and Support. We collect information you provide when you contact us, request support, or respond to surveys, including the content of your communications and related contact information.
Usage and Device Information. We automatically collect information about how you access and use the Platform, including IP address, browser type and settings, device identifiers, operating system, language preferences, referring/exit pages, pages viewed, links clicked, session dates/times, and the features you use. We also use cookies and similar technologies to support core platform functionality, authentication, security, analytics, and user preferences.
We do not collect sensitive categories of Personal Information beyond what is necessary to provide the Platform and Content. We do not use or process biometric data.
Cookies and Similar Technologies; Do Not Track
We use cookies, local storage, and similar technologies that are necessary to operate the Platform (for example, to keep you signed in, maintain session state, enhance security, remember preferences, and perform aggregate analytics to improve functionality). You can adjust your browser settings to refuse or delete cookies; however, some Platform features may not function properly without them.
We do not use cookies or other tracking technologies to serve interest-based or cross-context behavioral advertising on or off the Platform, and we do not sell or share Personal Information for cross-context behavioral advertising as that term is used in certain state privacy laws.
Some browsers offer a “Do Not Track” (DNT) setting. Because there is no uniform DNT standard, we do not respond to DNT signals.
How We Use Information
We use the information we collect solely to provide and support the Platform and Content and for closely related operational purposes, including to:
Provide, operate, maintain, secure, troubleshoot, and improve the Platform and the Content.
Authenticate Users, manage accounts and roles, and enable permitted educational use in accordance with our Terms of Use.
Provide support and respond to inquiries; send service-related notices (for example, account, security, or system notifications).
Analyze aggregate usage to improve reliability, performance, accessibility, and instructional efficacy of the Platform.
Comply with applicable law, protect the security and integrity of the Platform, prevent fraud, and enforce our Terms of Use.
We do not use student Personal Information to build profiles for non-educational purposes. We do not use Personal Information to engage in targeted advertising.
We may use de-identified or aggregate data to operate, analyze, and improve the Platform and Content, including for reporting on usage and outcomes. We take reasonable measures to de-identify data such that it cannot reasonably be linked to a particular individual.
How We Disclose Information
We disclose Personal Information only as described below and only as reasonably necessary to provide and support the Platform and Content or as required by law.
Service Providers (Processors). We may engage carefully selected vendors to host, support, and operate the Platform, provide cloud infrastructure, security, analytics, or customer support. These providers are contractually obligated to use Personal Information only to perform services on our behalf, to protect it with appropriate safeguards, and to delete it when services end.
Institutions and School Personnel. For school-directed use, student information, progress, scores, submissions, and related instructional data are disclosed to the student’s Institution and authorized School Personnel, consistent with the Institution’s educational program and FERPA.
Legal and Safety. We may disclose information if required by law or legal process, or if we believe in good faith that disclosure is reasonably necessary to protect the rights, safety, or property of Lexandria, our Users, students, or the public; to investigate fraud, security, or technical issues; or to enforce our Terms of Use.
Business Transactions. If Lexandria undergoes a corporate transaction such as a merger, acquisition, reorganization, or sale of assets, Personal Information may be transferred as part of the transaction. If student Personal Information is involved, the successor will be subject to substantially the same privacy commitments for such data.
We may disclose de-identified or aggregate information that does not identify an individual.
We do not disclose student Personal Information to third parties for their advertising or marketing purposes. We do not sell Personal Information.
Data Security
We implement commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, and destruction.
However, no system is 100% secure, and we cannot guarantee the security of your Personal Information transmitted to our Platform. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform.
You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. If you believe your account has been compromised, please notify us immediately.
Data Retention and Deletion
We retain Personal Information for as long as necessary to provide the Platform and Content, fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. For school-directed accounts, we retain Student Records for the period as required by the Institution and delete or de-identify them upon the Institution’s request or at termination of services, subject to any legal obligations.
If you deactivate your account or request deletion, we will delete or de-identify your Personal Information within a reasonable period, unless we are legally required or permitted to retain certain information (for example, for security, fraud prevention, recordkeeping, or compliance). We may retain and use de-identified or aggregate data.
Your Privacy Choices and State Privacy Rights
Nevada residents may submit a request to opt out of the sale of Personal Information at the contact information below. However, we do not currently sell Personal Information as defined by Nevada law to trigger that statute’s opt-out requirements.
By affirmatively indicating your consent when asked whether you would like to receive text messages from Lexandria, you are providing your express written consent to receive text messages from us using automated and/or peer-to-peer technology. You further affirm that, by providing such consent that you are at least 18 years of age or older and have the authority to grant such consent. Your mobile service provider may charge standard messaging, data, and other rates/fees related to any text transmissions. You may opt out at any time and for any reason.
As we have no control over how the mobile service providers transmit our text messages, we cannot be responsible or liable for any delays in your receipt of any of our text messages. We make no warranty concerning our text message services, express or implied, and all warranties, including implied warranties of merchantability and fitness for a particular purpose are expressly disclaimed. Our text messages are provided on an “as is” basis.
By opting-in to our text messages, you recognize we may collect certain data from you. Such data may include, but is not limited to, your mobile phone number, your mobile service provider’s name, and the date, time, and content of your messages to and from us, along with any other. You expressly agree that, in the event you forfeit or no longer utilize the cellular telephone number you used to subscribe to our text messaging campaign, you will immediately notify us of this change.
Text messaging opt-in data, consent, and related collected personal information will not be shared with or sold to any third parties, unless required by law or dedicated opt-in agreement.
Your Account and Access
If you have a Platform account, you may access and update certain account information by logging into your account settings. You may also contact us to request access, correction, or deletion of Personal Information that you have provided. For student accounts created by an Institution, please direct requests to the Institution; we will support the Institution in responding to such requests as required by law.
Third-Party Services, Links, and Embedded Media
This Privacy Policy applies only to the Platform and not to other websites or services accessible from the Platform, or that you use to access the Platform, each of which may have privacy policies materially different from this Privacy Policy. If you visit other websites or use other services, we are not responsible for the privacy practices or content of those sites. It is your responsibility to review the privacy policies of non-Lexandria websites and services to confirm that you understand and agree with them. Please review these third party’s privacy policy for more information.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our practices, technologies, legal requirements, or other factors. When we make material changes, we will post the updated Privacy Policy on the Platform, update the “Last Updated” date, and provide additional notice as required by law. Your continued use of the Platform after the effective date of an updated Privacy Policy constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the Platform.
